A monster 21-foot (6.4-meter) saltwater crocodile, believed to be the biggest ever captured, has been trapped in the southern Philippines after a spate of fatal attacks, officials said Tuesday.
The 1,075-kg (2,370-pound) male is suspected of eating a farmer who went missing in July in the town of Bunawan, and of killing a 12-year-old girl whose head was bitten off two years ago, crocodile hunter Rollie Sumiller said.
The hunter examined the crocodile's stomach contents by forcing it to vomit after it was captured Saturday, but there was no trace of human remains or of several water buffaloes also reported missing by locals.
"The community was relieved," Sumiller said of the capture, but added: "We're not really sure if this is the man-eater, because there have been other sightings of other crocodiles in the area."
The local government of the impoverished town of 30,000 people has decided against putting down the reptile, and will instead build a nature park where it will go on display.
Josefina de Leon, wildlife division chief at the Philippines environment ministry, said the beast was likely the biggest crocodile ever captured anywhere in the world.
"Based on existing records the largest that had been captured previously was 5.48 meters long," she told AFP.
The Philippine specimen would easily dwarf the largest captive saltwater crocodile, which the Guinness World Records website lists as Cassius, a 5.48-meter (18-foot) male which lives at an Australian nature park.
Press reports also describe other huge crocs including a 6.2-meter (20.3-foot) adult male killed in Papua New Guinea in 1982 that was measured after it was skinned.
The Bunawan hunting team, employed by a government-run crocodile breeding farm, began laying bait using chicken, pork and dog meat on August 15 in an attempt to snare the beast.
But the reptile, which measured three feet (0.91 meters) across its back, simply bit off both the meat and the line it was skewered on.
A heavy metal cable finally proved beyond the power of its jaws, and the beast was subdued in a creek late Saturday with the help of about 30 local men.
It was the team's second attempt after a failed expedition launched in response to the fatal 2009 attack.
Beyond the mark of the hook inside its upper jaw, the crocodile did not appear to have sustained any serious injuries, Sumiller said.
Bunawan Mayor Edwin Cox Elorde said the government would build a nature park showcasing the giant crocodile and other species found in the vast marshland on the upper reaches of the massive Agusan river basin on Mindanao island.
"It will be the biggest star of the park," Elorde told reporters.
Sumiller said the plan was the best option available for the creature.
"He's a problem crocodile that needs to be taken from the wild... and used for eco-tourism," he said.
Crocodylus porosus, or the estuarine crocodile, is the world's largest reptile. It grows to five or six metres in length and can live up to 100 years.
While not considered an endangered species globally, it is "critically endangered" in the Philippines, where it is hunted for its hide which is used in the fashion industry, de Leon said.
"There have been very few sightings of porosus in the wild in the Philippines in recent years," she added.

In July, a saltwater crocodile measuring almost 14 feet (4.2 meters) was caught on the western Philippine island of Palawan after it killed a man.

THE MEN’S HEALTH ALL-TERRAIN RACE


The Men’s Health All-Terrain Race (MH ATR) is the annual flagship event of Men’s Health Magazine. It is the most eagerly-anticipated races in the country by both mountain bikers and trail runners.  The MH ATR is also the perfect springboard for new riders and runners to try something new and to push their limit.

LOCATION


The 2010 Men’s Heath All-Terrain Race will be held in Nuvali, Sta. Rosa.  In this vast and naturally rich site in Laguna, participants will be running and/or riding on different types of terrain like pavement, dirt, compact dirt and grass.  They will also be admiring the view on top of a ravine, and getting wet while crossing a river on their way to the finish line.

The San Mateo "PADYAKAN LABAN SA TAMBAKAN"

A sequel to the previous FREE RIDE for FREE DUMPsites held last Dec.
27, 2008 which gathered 300++ concerned cycling advocates who took an
environmentally fellowship bike ride around the town of San Mateo to
announce to the general San Mateo residents that a gigantic dumpsite
is about to destroy and diminish their town into a massive heap of
garbage much like Payatas and Smokey Mountain. Along with it would be
our beloved Maarat trail which we enjoy riding freely in wooded fire
trails and forests during weekends.

From our previous experience last Dec. 27th's advocacy ride we have
seen a great effect in terms of its environmental awareness campaign
done by all cyclists who joined. This coming Saturday, January 17th at
the Aling Tinas Cycling Station and Resto, we shall now be joined by
international environmental and eco-waste experts such as Green Peace
and the Eco- Waste Council as well as the media who will join our
Fellowship ride to stop the massive dumping of garbage in San Mateo
forest's Bgy Maly and Guinang.

Once again the concerned cyclists from all over the Metro are calling
on ALL cyclists Mountain bikers and Roadies alike to once again join
and be the voice of the San Mateo residents to the world. This
Saturday, we are expecting at least 500 riders from all over the metro
who will join this fellowship FREE RIDE for a cause. We hope you can
all share in this momentous and historic cycling occasion.

Details of the cycling event are as follows:

The event will be on January 17, 2009; Registration starts at 6:30am.
Critical mass ride starts at 8:00am.

Other than being a FREE RIDE for a cause, upon registration; the first
500 cycling registrants will receive a FREE The San Mateo "PADYAKAN
LABAN SA TAMBAKAN" event T-shirt (It's a nicely cool shirt, S,M,L,XL
sizes available) and a food coupon that entitles a FREE post event
ride breakfast at Aling TINA's resto and cycling station in Daang
Pari, Ampid, along Maarat rd. San Mateo, Rizal. (Befrore climbing The
WALL).

All for FREE (T-Shirts, Food/ Drinks and Fun Bike Fellowship) for the
FIRST 500 cyclista participants who register early. Cool huh?

The ride will simply cover approximately 15kms from Aling TINA's
Maarat rd. go out towards the Marikina / Sn. Mateo main Rd towards San
mateo towns and residents then converge at the Nuestra Senora de
Aransasu Church beside McDonalds where a priest will bless the riders
and some excellent guest speakers will share the meaning of this
historic ride for a cause to free San Mateo and our Maarat Trails from
massive dumpsites. Then upon convergence the group will then proceed
back and clinb the semi-sloped Batasang Pambansa rd. going towards
Commonwealth Avenue then back to Sn Mateo rd then back to Aling TINA's
for FREE post ride breakfast.

We hope we can all support our 2nd FREE RIDE for a cause this first
month of 2009. Let us all help save our natural cycling trails and our
forests so we can be able to allow our next generation to enjoy the
clean and wholesome bike trails and forests we now enjoy.

We : Chris, Grace, Geoff, Angel, James and her mom, I forgot her name, are here in Dumagete around 8:30 to 9:00am. So we decided to eat first early lunch and taste the best food in Dumagete, We choose to go to the market place from the airport going to market just ride a jeep cost of 8php then go to panties carinderia, there are many cheap fast food available. I ordered karahay, karahay stands for kawale, karahay is like litson kawale. sarap the best. Another one is Babakwa, balbakwa is like bulalo but more seasoning and taste like bulalo.

And after that we decided to go to the port by tricyle. Going in apo island is 30mins to 1 hour estimated time of arrival by boat or by bus but we have a choice to ride a bus, we go to bus station of ceres then the sign board is bayawan to malatapay, then while we are walking going to the port one of us meet a friend inside the bus of malatapay to apo island is boat transfer, boat ride 1500php per boat balikan.

On 08.31.08, Nike is making a statement like no other before. Nike is putting on the World’s Largest Running Event. The 10k event will be the ultimate runner experience. By combining our digital running world with the physical, the Nike+ Human Race is open to anyone, anywhere. Why did Nike decide to organize this event?
Simply put, Nike is celebrating runners and their sport. This is going to be the World’s Largest Running Event and provide a global connection point for every athlete. By using tools that we’ve created like Nike+ and the Nike+ SportBand, now people can participate from anywhere: a country road, an urban sidewalk or at one of our 25 designated Nike+ Human Race cities. Race sites were also selected to accommodate the largest number of runners. Strategic cities from all over the world have been selected with these considerations in mind. We wanted our runners to have the best event experience possible.

How do I sign up?
Visit www.nikeplus.com to access the Nike+ Human Race Web site and registration form where you can sign up online or download a PDF version for mail in registration. Sign up to run in one of the 25 physical race cities or in your neighborhood. You do not have to be a nikeplus.com member to sign up.

When do I sign up?
You can visit nikeplus.com and save your spot now. On June 2nd anyone can officially sign up for the Nike+ Human Race.

Is there a registration deadline?
Countries may cap registration based on race course capacity for the physical race, but there is no registration deadline. You can reserve your spot online now before the global registration begins on June 2nd.

How much does the race cost?

Will I get to see what’s going on in other cities on race day?

I notice the race day tee lists 29 cities, but there are only 25 cities that will hold an event. What happened to the others?
We initially planned to host 10k runs in all 29 cities listed, but to provide the best running experience possible, we wanted to focus on the 25 listed. We made this decision after the tees had gone to production.

Will there be a charity component for the Nike+ Human Race?
Yes. As participants in the Nike+ Human Race, runners will be able to run for a cause. We will be providing more information about charitable giving on July 2nd.

Iraq leader, Obama discuss future troop pullout

BAGHDAD, Iraq - Sen. Barack Obama and Iraqi Prime Minister Nuri al-Maliki on Monday discussed a "general time horizon" for any American troop withdrawals from Iraq, al-Maliki's office said.

Obama -- who has made ending the Iraq war a cornerstone of his run for office -- engaged in what were described as productive talks with al-Maliki during a trip to Iraq.

The Iraqi government has been pushing for the United States to set a general timetable to spell out troop withdrawals.

Iraqi Vice President Tariq al-Hashimi also met with Obama Monday and told reporters afterward they discussed the security agreement.

"I told Sen. Obama (that) Iraqi and American negotiations regarding this are ongoing, and today new Iraqi-American negotiations on this agreement have started with Iraqi written proposals and have a timetable for the withdrawal of U.S. troops from Iraq," he said.

The Bush administration has opposed timetables for troop withdrawals. But al-Maliki and President Bush last week agreed to a "general time horizon for meeting aspirational goals" on troop cuts.

The prime minister reiterated that principle with Obama, according to a statement from al-Maliki's office.

"Developments of the situation and the circumstances is what will decide the presence of foreign troops in Iraq, but without keeping open-ended dates," al-Maliki said, according to a statement from his office.

Obama's Trip

Sen. Barack Obama is set to step onto the world's stage. During his trip to the Middle East and Europe, Obama will visit:

  • United Kingdom

"With the developments on the ground, we can set a vision and clear horizons regarding this issue, and this is a view both sides agree on in the ongoing negotiations."

Al-Maliki's office quoted obama as saying he is "supportive and committed to preserving the gains achieved by the Iraqi government" under al-Maliki's leadership and that he admires the prime minister's courage.

Obama has proposed withdrawing U.S. combat troops from Iraq within 16 months of taking office. Spokesman Ali al-Dabbagh said the Iraqi government's "vision" is that most U.S. combat troops would be out of Iraq by 2010. Asked if that stance is part of the current negotiations, al-Dabbagh said, "No. This is the Iraqi vision."

A German magazine on Saturday quoted al-Maliki as saying he backed Obama's proposal, but al-Dabbagh has said that his remarks "were misunderstood, mistranslated and not conveyed accurately."

In a statement Sunday, the magazine, Der Spiegel, said it "stands by its version of this interview."

In the magazine interview, al-Maliki did not indicate that he was endorsing Obama over Sen.

John Mcaine, the presumptive Republican nominee.

McCain does not think American troops should return to the United States until Iraqi forces are capable of maintaining a safe, democratic state. He has been a strong advocate of the "surge" -- the 2007 escalation of U.S. troops -- and has said troops should stay in Iraq as long as needed.

Louisiana Gov. Bobby Jindal -- who's been mentioned as a possible vice presidential pick for McCain -- on Monday criticized Obama's push to remove troops in 16 months as an "arbitrary timetable based on politics versus a plan based on the actual results on the ground."

"One of the reasons I'm supporting [McCain] -- he has made it clear he would rather lose an election than lose a war. He's made it very clear -- let's listen to the commanders on the ground," Jindal said on CNN's "American Morning."

McCain last week chided Obama for laying out his plans for Iraq and Afghanistan before talking to Gen. David Petraeus, the head of U.S. troops in Iraq.

Obama met with Petraeus and Ryan Crocker, the U.S. ambassador to Iraq, in Baghdad on Monday.

He also met with Tariq al-Hashimi, a Sunni Arab who is one of Iraq's two vice presidents; Lt. Gen. Lloyd Austin, commander of Multi-National Corps-Iraq; British Maj. Gen. Barney White Spunner, commander of Multi-National Division South East; and Maj. General Abdul Aziz, the Iraqi army's 14th Division commander.

Obama's stop in Iraq marks his second visit to the country. The presumptive Democratic presidential nominee's trip abroad began in Kuwait and Afghanistan and will go on to Jordan, Israel, the West Bank, Germany, France and Britain. The senator from Illinois first visited Iraq in 2006.

Obama arrived Monday afternoon in the southern city of Basra, according to U.S. Embassy spokesman Armand Cucciniello.

Obama is traveling with Sen. Jack Reed of Rhode Island, a leading Democrat on the Senate Armed Services Committee, and Sen. Chuck Hagel, a Nebraska Republican who serves on the Foreign Relations Committee and is an outspoken critic of the Iraq war.

Obama has said that if he's elected, he would commit more troops to Afghanistan and would order the military to end the war in Iraq, which he has called a "dangerous distraction" from the Afghan battle.

Obama spent Saturday and Sunday in Afghanistan, where he met with U.S. troops at three bases and with Afghan President Hamid Karzai -- a leader the Democratic senator has criticized for doing too little to rebuild the war-torn nation.

The fight in Afghanistan recently has become a more pressing issue on the political radar. More coalition forces have died in Afghanistan than in Iraq in May, June and so far in July.

Last week, in a major address laying out his foreign policy position, Obama said, "As should have been apparent to President Bush and Sen. McCain, the central front in the war on terror is not Iraq, and it never was."

Aid workers for groups fighting for women's rights say Moscow is witnessing a surge in prostitution, including forced prostitution, as a result of Russia's booming economy.

They say thousands of young women are made to work as sex slaves on the city's streets, unable to escape from the ruthless and violent criminal gangs who traffic them.

"It's because of the economic boom they are brought here," said Afsona Kadyrova of the Angel Coalition aid agency, which rehabilitates trafficked women and children. "The fast pace of development in Moscow has fueled demand for a range of cheap workers, including prostitutes."

To investigate the thriving trade, CNN went undercover posing as potential customers and gained access to speak directly to the prostitutes and their pimps.

"Take your pick from any of the girls," the female organizer said at one location, lines of women all around. "The expensive ones are on the right, for $600 and $700 a night. The women on the left are $100."

Aid agencies say many of the women working here are tricked into coming to Moscow on the promise of an education or a good job. They say others are simply kidnapped from their hometowns and forced to work as prostitutes in Moscow.

Russian police acknowledge that human trafficking for sexual exploitation is a major problem, saying they do what they can to fight it by raiding brothels suspected of forced prostitution and arresting gang members who run them. But the problem, they say, lies elsewhere.

"First of all, we have virtually open borders, and badly controlled migration flows from nearby countries," said Alexander Krasnov of Russia's Interior Ministry Police.

"Secondly, we still don't have a basic law that defines victims' rights. At the moment, it's mostly aid agencies that deal with it."

Aid agencies say they are handling a growing number of deeply traumatized victims rescued from brothels and pimps in the Moscow area. One U.N. organization, the International Organization for Migration, recently opened a treatment and rehabilitation center to cope with the large numbers of sexually exploited and trafficked women who come for help.

At this center, Christine, a 27-year-old Nigerian woman, tells how she acquired a painful 4-inch scar across her right cheek. She says she was lured to Russia from Nigeria four years ago by her uncle. He promised to give her a college education, she says.

But instead, she says, he sent her to a Moscow brothel. He told her "the kind of job I'm going to be doing is prostitution."

"I ask him, 'Why prostitution? Why not another job to pay the money?' He says I didn't speak the language. I cannot do any other job."

She added, "It made me feel very bad. I felt that I'm not going to do it over my dead body."

But when she tried to run away, her uncle cut her face, says Christine, who asked that her last name not be used.

"He made me know that if I don't cooperate with him, something bad will happen to me -- that if I made an attempt to run away, it would end in taking my life. So I was really scared about that," she said.

Aid workers say Russia has become a prime destination for trafficked women from Africa, the Far East and former Soviet states. There are no exact figures, but aid agencies estimate that thousands of trafficked women are on Moscow's streets.

"Before, it was just a country of origin for Europe and the U.S. and elsewhere in the world," Kadyrova said. "But right now, we see that Russia has become a destination country also."

According to the group's Web site, human traffickers "prey on the dreams of impoverished women seeking employment and opportunities for the future." Most women are young and single with little education; some are orphans and college students; others are married with children.

"All of them are lured by advertising images of a beautiful life beyond the borders of their homelands -- making them easy prey to the thousands of traffickers advertising in newspapers, on radio, television, in the metro and on the streets for wonderful work abroad with no experience necessary," the group says.

For millions, Russia's new economic prosperity has been a blessing. But for those caught up in the sex trade, it's a curse.

Christine managed to escape after meeting a woman from a church who helped her. "I was crying all the time, telling her, 'I don't want this kind of job,' " she said.

DIXVILLE NOTCH, New Hampshire (CNN) -- Citizens went to the polls in two small New Hampshire towns just after midnight Tuesday to cast the first ballots in a 2008 presidential primary.

In Dixville Notch, they gave Sen. John McCain an early lead in the GOP race and Sen. Barack Obama a lead in the Democratic contest.

McCain garnered four votes, followed by former Massachusetts Gov. Mitt Romney with two and former New York Mayor Rudy Giuliani with one.

Obama, fresh off a victory in the Iowa caucuses, took seven votes. Former Sen. John Edwards won two votes, and New Mexico Gov. Bill Richardson got one.

Sen. Hillary Clinton drew no votes among the 10 Democrats casting ballots in Dixville Notch, a hamlet of about 75 people near the Canadian border.

In Hart's Location, population 42, Obama received nine votes, Clinton three and Edwards one, The Associated Press reported. On the GOP side, McCain received six, Mike Huckabee five, Ron Paul four and Romney one.

For the rest of the state, most polls open at 6 a.m.; the last close at 8 p.m.

Leading up to the primary, the top contenders were scrambling to nail down supporters among an electorate notorious for its independence.

Obama worked to turn an apparent boost in the polls after the Iowa caucuses into a second victory over his leading rivals, Clinton and Edwards. And McCain expressed confidence that he would win the day's Republican primary, a contest he won during his first White House bid eight years ago.

"We are going to prove that you can't buy an election in the state of New Hampshire -- and we are also going to prove that negative attack ads don't work either," he said Monday in a jab at Romney, his leading rival.

Romney has poured $8 million into television ads in the Granite State, outspending McCain 2-to-1, according to figures from TNS Media Intelligence/CMAG, CNN's consultant on television campaign advertising.

But a CNN/WMUR poll of likely voters released Monday night showed McCain leading Romney by a margin of 31 to 26 percentage points.

Change was the buzzword on all the candidates' lips Monday. Speaking in Nashua, Romney emphasized his experience in business and in shaking up the 2002 Winter Olympic effort rather than his experience in public office.

"If there has ever been a time we need a change in Washington, it's now," Romney said. "Because in my experience, what I've heard as I travel this country is that Washington is broken."

Romney also spent heavily in Iowa, only to be beaten by Huckabee. The former Arkansas governor won Iowa with extensive support from evangelical Christian voters, but was running third in more secular, libertarian New Hampshire with 13 percent, Monday's poll found.

"If we come in anywhere in the third or fourth spot, we are going to be doing great," he said on CNN Monday.

New Hampshire's independent voters, who make up about 40 percent of the state's electorate, could throw a surprise into the primaries, however.

McCain's 2000 victory came on the backs of a strong independent turnout in the GOP primary, but a CNN-WMUR poll Sunday found independent voters split almost evenly between the parties this year.

And more than 20 percent of respondents on both sides said they either had not yet made up their minds or are still open to changing their minds before voting.

Among Democrats, Monday's poll found Obama riding a 9-point lead over Clinton, 39 percent to 30 percent. Edwards, who edged out Clinton for second place in Iowa, ran third with 16 percent.

Obama's theme of "hope" has drawn crowds, but also criticism from rivals who suggest he will be too soft to deliver the change he promises. The first-term Illinois senator defended his message Monday, telling a crowd in Rochester that hope "is not blind optimism."

"Hope's the opposite of that," he said. "Hope's not ignoring the challenges and obstacles that stand in your way, it's about confronting them."

Meanwhile, he said, "The real gamble would be to have the same old folks doing the same old things over and over and over again and somehow expecting a different result."

Clinton has tried to turn the tide by emphasizing her record as a "change agent," as a senator and as first lady. She fought tears as she described the stakes in the campaign at a forum with uncommitted voters in Portsmouth, calling it "one of the most important elections America has ever faced."

"This is very personal for me -- it's not just political, it's not just public," she said in response to a question about the stress of the campaign. "I see what's happening, and we have to reverse it."

Edwards, meanwhile, sharpened his criticism of Clinton, blasting her for taking money from the pharmaceutical and defense interests the former trial lawyer routinely excoriates on the stump.

"What has been happening in America is it is big corporate businesses and big multinational corporations that have entirely too much influence on the policy," he told CNN.

Richardson, who was polling fourth among Democrats at 7 percent, said he has set his sights on the remaining undecided voters.

"With Bill Richardson, you get change and you get experience," the former U.N. ambassador and energy secretary told CNN. "You have to have experience to change things. I have a record."

Rep. Dennis Kucinich and former Alaska Sen. Mike Gravel also remain in the Democratic field.

Among the Republican pack, former Tennessee Sen. Fred Thompson has virtually abandoned New Hampshire, while Giuliani has limited his campaigning in early states to focus on the Florida primary later in the month and the February 5 "Super Tuesday" contests.

Paul, an anti-war Texas congressman and onetime Libertarian Party presidential nominee, was drawing 10 percent support in Monday's poll, and a growing number of independents have told pollsters they are considering voting for him.

"The big trouble that we have over the last year was you know, getting our message out," Paul told CNN. "And now, the money is flowing in, the money comes in faster than we can spend it. Because when people hear this message, they get so excited about it."

We, the Officers and Members of the Armed Forces of the Philippines and the Philippine National Police, loyal to God and country and to our duty under the Constitution, do hereby make the following declaration:

A crisis of extreme proportions now confronts our people. The economy, the rule of law and the moral order lie in ruins. Political, judicial and economic power, as well as the power of the mass media, has been perverted to inflict and justify high crimes against the Filipino people. More and more among our people no longer eat, while the idle rich and the corrupt live like kings. Minority rule has replaced majority rule. The three branches of government are now in total disarray, the entire system has broken down, thanks to a President whose legitimacy is denied by the vast majority of our people.

Corruption has not only become a way of life among those in power. It has also become the most effective means of destroying our country and people. Mrs. Gloria Macapagal Arroyo has played a key role in promoting corruption to its present levels. In her mad desire for power, she has corrupted and destroyed all institutions. She has promoted a policy of loot and plunder while hypocritically announcing a war against corruption.

She has corrupted the justices of the Supreme Court, the entire Commission on Elections, the mass media, some members of the military, the police and the clergy, and countless teachers who took part in counting the votes in the last elections. She is not only the most corrupt official in the country today. She is also its No. 1 corruptor.

We cannot stand idly by while the rule of law, the moral order, the integrity of our institutions, the very future of our country and the people, and our own professional careers are destroyed by this bogus President. We cannot afford to do nothing while she and her cohorts turn our government into a criminal syndicate. We cannot allow ourselves to be used as a tool of injustice and oppression. We must act, and we must act now.

Pursuant, therefore, to our constitutional duty as “protector of the people and the state,” we have today withdrawn our support from Mrs. Gloria Macapagal Arroyo, in order to end her unconstitutional and illegal occupation of the Presidency.

This we have done to restore the rule of law and public morality, the legitimacy and accountability of government, the integrity of our public institutions, the sanctity of the democratic process, and the trust and confidence of our people and the rest of the world.

We call on all our comrades-in-arms to discharge their genuine responsibilities to our people with full dedication and fervor. We call on our people to support the men and women at the forefront of this undertaking. We call on Mrs. Arroyo to accept gracefully the formation of a new government.

As soldiers, we do not seek political power for ourselves. But we shall not allow anyone to use political power to commit crimes against our people or to pursue their own personal agenda, at the expense of the national interest. We shall maintain law and order, prevent any group from taking advantage of the situation, and protect the innocent from all possible harm. We shall leave the actual business of governing the nation in the hands of professionally competent, morally upright, patriotic, trustworthy and self-sacrificing Filipinos whom we now invite to form a new government.

This may be our last chance to correct our past mistakes. We cannot afford to fail. We must not fail.

We appeal to everyone to give this effort a chance to succeed. We appeal to all our people to unite and extend all the support and counsel which the new government will need from them. We pray to Almighty God to bless our efforts and keep us pure and strong in this hour of need.

The Oakwood Agreement

The following are the terms of the Oakwood Agreement, which was approved by the so-called Magdalo soldiers and the government represented by Gen. Roy Cimatu (Ret.):

· Only the five (5) leaders named will suffer the consequences of the actions of the whole group at Oakwood. The five (5) are: Cpt Gary Alejano PN(M), Cpt Gerardo Gambala PA, Cpt Milo Maestrecampo PA, LTSG James Layug PN and LTSG Antonio Trillanes IV. All the rest shall only be admonished under the provisions of AW 105.

· There will be an independent investigation on the status of RSBS.

· There will be an independent investigation on the selling of arms and ammunition to the enemies of the state.

· There will be an independent investigation on the bombings in Davao and other areas in Mindanao.

· There will be an independent investigation on the extent of corruption in the AFP.

The agreement was witnessed by Mr Max Soliven, VADM Ruben Domingo, COMMO Tirso Danga, BGEN Danilo Lim, CAPT Feliciano Anggue PN, COL Oban PAF, Usec Abraham Purugganan, and Gen Dionisio Santiago (Ret). The above terms were approved by GMA through a phone call made by Gen Cimatu. As further proof of Malacanang’s approval of the Oakwood Agreement, the terms were broadcasted live on national TV by then AFP Chief of Staff Gen Narciso Abaya before the Magdalo soldiers agreed to stand down.

Starting 29 July 2003 all officers and EP who participated in the Oakwood Incident were detained in direct contravention of the agreement.

A few weeks after the incident, the Maniwang and Feliciano Commissions were created by the government to conduct the investigations as stated in the agreement. Both commissions exonerated both the GMA administration and the AFP of any wrongdoing.

In Aug 2003, two (2) Marine officers testified in the Senate regarding the selling of arms and ammunition to lawless elements in Jolo. In fact, a marine company was even directed by Southcom to transport and deliver the said items to a drop-off point at a roadside. This was admitted by then Southcom Chief LTGEN Padiernos. The tragic irony is that these same guns and ammunition may have been the same ones used against the Marines in the recent clashes in Jolo, which killed at least 12 and wounded more than 20 of them.

In Oct 2006, Defense Sec. Avelino Cruz declared that because of its bankruptcy, the RSBS would shut down its operation.

Alleged coup plotter finds ally in former vice president

MANILA, Philippines -- (UPDATE) Colonel Ariel Querubin, one of the alleged leaders of the botched February 2006 coup, found an ally in former vice president Teofisto Guingona, who attended the officer’s habeas corpus hearing at the Court of Appeals on Thursday.

Guingona, who wore a button pin bearing Querubin’s face, sat beside the colonel during the proceedings.

“I give full support to Colonel Querubin because I know how it means to be imprisoned,” Guingona told reporters after the hearing.

“I think justice will be served… I think we will get out of this soon,” Querubin said.

Mrs. Querubin questioned her husband's detention citing the pre-trial advice (PTA), which was not signed by Armed Forces Chief of Staff General Hermogenes Esperon Jr.

In the PTA, Esperon approved the filing of mutiny charges against Querubin and 27 other Marine and Army Scout Ranger officers, overturning recommendations by military prosecutors to charge them only with lesser charges.

"The confinement is not only unlawful, it also has no basis in fact and in law," Querubin's lawyer, Sigfrid Fortun, told the three justices of the appellate courts 5th division.

Fortun said the PTA was the equivalent of an indictment in criminal courts, without which, suspects could not be detained.

"This is about a valid indictment. If there is no valid indictment, Colonel Querubin should be allowed to go scot-free," he said.

He said this should apply to Querubin's case, even if he is under military law. "[Soldiers] are not a class of people with separate rights. They have rights under the Constitution."

"One and a half years of this soldier's productive life has been lost," Fortun said, adding. "He is not a flight risk, with seven children and a homemaker wife. He should be allowed to go [out of detention]."

Fortun said Querubin should freed, since if the original recommendation of military prosecutors was to charge him only for violation of Articles of War 96 (conduct unbecoming an officer and a gentleman) and 97 (conduct prejudicial to good order and military discipline).

Querubin and his co-accused have been detained at a maximum security facility in Camp Capinpin in Tanay town, Rizal province, since mid-2006.

Arguing the case of the government, Assistant Solicitor General Amparo Cabotaje-Tang, said Esperon did not need to sign the PTA, since there was an "amended charge sheet" that included mutiny.

"Even without signing [the PTA]. It was effectively and legally approved," Tang said.

The presiding justice, Martin Villarama, grilled Tang on her argument.

"He can just put a line there. Approved or disapproved. Why do you think is the reason?" Villarama said.

To, which, Tang replied: "I was not informed of the reason [why Esperon did not sign]."

Villarama then said: "Effectively approved? Why did he not say so? It will only take him two seconds [to sign]."

Tang also accused Querubin's camp of "forum shopping," saying he also has a pending petition for certiorari, questioning the legality of the court martial trying him.

Fortun countered, saying his client's detention and the jurisdiction of the court martial were two different issues.

Villarama gave both sides 15 days from Wednesday to submit memoranda, for Querubin's camp to prove that they were not forum shopping, and for the Solicitor General to cite precedents when a PTA was not needed to send a case to court martial

WHEREAS, Vice President Noli De Castro is a member of the Arroyo cabinet and is a beneficiary of the cheating perpetrated during the May 2004 Elections and is also considered to be a silent partner in crime of GMA not only because of his close personal association and unflinching support for GMA but also because of his failure to stand-up against and denounce the abuses and excesses of the Arroyo regime;

WHEREAS, the recent Glorietta bombing incident appears to be a signal for the more violent phase in the regime of GMA;

WHEREAS, the sham impeachment case filed by personalities connected with Malacanang effectively sabotages and ridicules the impeachment process;

WHEREAS, the only peaceful, legal and constitutional option available to the Nation under the circumstances and to prevent the situation from developing into a full-scale conflict or civil strife is for GMA and Noli De Castro to resign from their respective positions as President and Vice-President, of the Republic of the Philippines;

WHEREAS, the 1987 Constitution, under Section 10, Article VII, expressly provides that:

“Sec. 10. The Congress shall, at ten o’clock in the morning of the third day after the vacancy in the offices of the President and Vice-President occurs, convene in accordance with its rules without need of a call and within seven days enact a law calling for a special election to elect a President and a Vice-President to be held not earlier than forty-five days nor later than sixty days from the time of such call. Xxx.”

NOW, WHEREFORE, We the undersigned citizens, taxpayers and voters of the Republic of the Philippines, in our capacity as the true sovereign of the Nation, DO HEREBY:

1. Call upon Gloria Macapagal-Arroyo and Noli De Castro to spare the country from further turmoil and violence by immediately resigning from their respective positions as President and Vice-President of the Philippines;

No Plea Bargain

This statement is intended to explain why I refuse to enter into any form of plea bargaining in any of my cases arising from the Oakwood incident.

To begin, I must make it clear that I respect my co-accused, and hold no adverse opinion on their decisions to consider or enter into plea bargains. Their beliefs are their own, as is their right to chart the courses of their own lives.

When I went to Oakwood, four years ago, it was clear to me that in order for me to bring the truth to my countrymen, I could stand to lose my life, my career or everything I hold dear. Standing trial and facing possible conviction for various offenses are natural consequences of my decision to tell the truth. Thus, I hold no rancor for those who must compel me to submit to the legal processes, even as I expect no justice to come out of such processes.

Years later, it is to my sorrow that no significant changes have taken place despite our warnings, our concerns and our acts in Oakwood. The system is as corrupt as ever, the military is now more politicized than ever before and the highest executive in the land holds office in spite of the absence of a clear mandate. Even sadder, our soldiers are still needlessly dying out there.

I have since learned that I must cast my lot with the majority of the Filipino people who, despite the recent electoral exercises, remain outside of the decision making processes exercised by our public officials, and therefore remain powerless. -
PILIPINO.ORG was born from this difficult lesson.

With these in mind, I refuse to bargain with the dubious authorities who exercise power without conscience and who are responsible for the ills that I felt compelled to report to my countrymen. At any rate, an agreement of this nature would be a tacit ratification or recognition of Presidential powers that lie uneasily in the wrong hands.

If this refusal to bargain means a prison term or the loss of my life, I am prepared, now, as much as I was four years ago, to pay the price for telling the truth.
